The Family and Medical Leave Act Essay The Family and Medical Leave Act sets regulations for job-protected leave related to family and medical reasons. FMLA applies to organizations with 50 or more employees working within 75 miles of the employee’s worksite (â€Å"Employment Laws,† n.d., para. 6). Employees who have been with their current employer for 12 months and who have worked 1250 hours of service in the previous 12 months are eligible for 12 weeks of unpaid leave through FMLA (â€Å"Eligibility Requirements,† Revised 2013). FMLA covers the following leave reasons: The birth of a child, or the placement of an adopted or foster child. A serious health condition that makes the employee unable to perform the essential functions of their job. To care for a spouse, child or parent with a serious health condition. A â€Å"qualifying exigency† arising out of a covered family member’s active duty or call to active duty in the armed forced. To care for a covered family member who has suffered an injury or illness while on active duty. Employees must be restored to their position or equivalent position when returning from leave (â€Å"Benefits and Protections,† Revised 2013). The use of accrued paid leave can be determined by individual organizations, but should be documented in a policy. It is important for an organization to create a leave policy that complies with FMLA and be consistent when applying the policy. The Family and Medical Leave Act can provide stability to employees, but can be tricky to administer. Company X needs to consider a few factors to ensure FMLA compliance. Paternal leave is included under FMLA, so Company X was in compliance when they granted leave to Employee A (assuming the employee has also worked a minimum of 1250 hours). Employee A was eligible for 12 weeks of leave, but voluntarily decided to return early. FMLA does not require Company X to pay Employee A while on leave, denying that request was also in compliance with the law. Company X met the FMLA requirements, allowing Employee A to return to the same position with the same rate of pay. My conclusion is that Company X has not violated FMLA requirements. I would recommend Company X create a policy that documents FMLA procedures and clarifies what to expect while on leave (salary and benefits). Situation B As Human Resources professionals, it is key to be mindful of protected job classes, particularly age. The Age Discrimination in Employment Act of 1967 was put in place to protect workers over 40 years of age. The ADEA applies to employers with more than 20 employees and applies to all aspects of employment, including hiring, firing, promotion, layoff, compensation, benefits, job assignments and training (â€Å"Facts About Age Discrimination,† Revised 2008). Since the ADEA applies to the hiring process as well as the term of employment, employers are not allowed to ask for date of birth in any pre-hire process. There are a couple of exceptions to the law. Employees may waive their right to the act as long as the ADEA guidelines are met. In certain situations, high level executives may be asked to retire at 65 and for jobs with bona fide occupational qualifications employers may discriminate based on age (â€Å"Exceptions to the ADEA,† 2007). An example of this would be a modeling agency hiring for an ad that promotes children’s clothing. Based off of the information provided, Company X is in clear violation of the ADEA. Employee B is over 40 and therefore in a protected job class. Unless they have reason to justify their decision, employee B has a clear case for discrimination. Since employee B has higher performance and longer tenure, the promotion should have been granted. My recommendation to Company X is to create a documented policy the outlines what factors are used in promotions and rank employees accordingly. In my opinion, performance should always be first. Other factors to consider could be attendance/accountability, education and seniority. If company X followed this policy, there would be no question of age discrimination. Situation C The Americans with Disabilities Act of 1990 prohibits job discrimination against people with disabilities. The ADA applies to all terms of recruitment and employment for employers with 15 or more employees (â€Å"ADA Questions and Answers,† (Revised 2009). Under the ADA, it is illegal to discriminate against qualified individuals and requires employers to make reasonable accommodations to ensure individuals with disabilities can perform the essential functions of their job. Reasonable accommodations are modifications or adjustments to the work environment that would allow someone the ability to do their job (â€Å"ADA Questions and Answers,† (Revised  2009). Reasonable accommodations may not bring undue hardship to an employer or require significant difficulty or expense. When complying with the ADA, job descriptions will help provide an outline of essentials functions of a job. In order to know if someone is able to perform the essential functions, a job description must be documented. Assuming that Applicant C was the most qualified candidate, Company X would be in violation of the ADA for denying employment. Since Applicant C is able to perform the essential functions of the position with one modification to the office, it would be discriminatory to disqualify the candidate. An additional elevator keypad would not cause operational harm to the organization and cannot be considered undue hardship. Analysis of Agency Theory

Analysis of Agency Theory Agency theory is one of the most important concepts of the business areas especially financial economics. Because of its importance, this theory is included in most of the introductory chapters of the modern financial economics books and publications. It is commonly cited as one of the key areas for progress and improvement of the modern financial economics. Moreover, its assumptions provide wide explanations for crucial business areas such as: merger activities, dividend policies, capital structure, corporate restructuring, and executive compensations, etc Agency theory defines the company or the firm as â€Å"nexus of contracts† between different resource suppliers. It is centralized on two different parties: principal, who supply the capital, and the agent who manage the day to day operations for the firm. In other words, it is the relation between one who determines the work and another who does the work. For example, in corporations, principals are the shareholders who delegates work to the agent which is the manager in the company. Agency theory assumes that shareholders and managers are motivated by their self –interest, thus managers are likely to persist their self-interest goal that contradicts with the goals of the owner. However, agents are supposed to work for the self-interest of the principal. This conflict results with a cost called the agency cost. This cost represents the cost of supervising the behavior of the agents as well as the profit loss resulting from operating policies and restrictions on managem ent. Although the agency theory is controversial and contradictory, many scientist talked about this concept and explained its advantages and disadvantages on many business fields’ especially financial economics. Many scientist and scholars talked about the agency theory, and it is one of the most crucial theory in the economic and financial history fields. This theory was originated and created by two scholars, Stephen Ross and Barry Mitnick. Each one had a take a part of the agency theory and created. Economic wise, Stepeh Ross is the one responsible for the economic theory of agency, and financial wise, Barry Mitnick is responsible for the institutional theory of agency. These two scholars used the same concepts but under different assumption. Everyone introduced the theory in his own way or thinking. Ross introduces the agency theory from the side of problems of compensation relation and as an incentive problem. On the other side, Mitnick introduced how the institutions should evolve to deal with deficiencies that is created by the agency relationships. According to Mitnick, â€Å"Behavior never occurs as it is preferred by the principal because it does not pay to make it perfect.† This is the main problem that Mitnick suggest as a deficiency of the agency relationship and he suggested that the society created rules and policies that help the companies to attend these imperfections, managing to deal with them, and adapting to them. Therefore, in order to understand the agency, people need both sides to see the incentive side as well as the organizational structure. However, this theory did not accurately defined properly and introduced to the world until the initiation of Jensen and Meckling articles in 1976. Jensen and Meckling introduces the agency theory as a relationship problem that arises between the owner of the resources and the one who is managing those resources. More general speaking, a conflict can arise between one who owns the capital and the one who is controlling the day to day operation since every party has his own interest that wants to be achieved and those interests can be contradictory. According to Jensen and Meckling, â€Å"Agency cos t arise from the conflict of interest between a principal and an agent.† For example, when managers, who are responsible for decisions that impact the operation of the firm, are not the primary beneficiary of the firm net assets, and do not accept any effect regarding his or her decisions. Moreover, the agency cost is divided into three type of cost: structuring cost, monitoring cost, and bonding cost. Structuring cost is the cost that a firm should take it when manufacturing any product or service such as transaction cost, suck cost, and fixed cost. It is the fixed cost divided by the variable cost. Monitoring cost is watching and supervising the recording of cost daily, weekly, monthly, and yearly. It is very important for the owner to have mangers that allocate the proper time to the proper work and minimize cost as much possible. Due to this problem, Jensen offers many solutions to save the firm from this problem. Setting the use of contract is a cost that the firm should use in order to align the actions of the mangers with the actions of the owner. As Jensen (1994) suggests, â€Å"Managerial decisions designed to strengthen organizations often meet with opposition from colleagues, employees†¦ providing managers with incentives to compromise their decisions.† In other words, the best way to insure that the decisions are not conflicting is to ensure that the trade-off that mangers face are pushing them to take the correct decisions. Therefore, the goal of the agent should increase the firm wealth that lead to increase the performance and market price. Moreover, in order the manager to increase value of the firm, the owner should create compensation plan that trigger the agent to spend his or her efforts or works to maximize the firm profits and productivity. According to the agency theory, the shareholder should have the sense that offering a compensation package to the agents can reduce the agency cost which means that interest of the two parties will be in the interest of the firm as whole, and the two parties will be one team working to maximize the value and the wealth of the organization. The agency theory creates many obligations that shareholders must take into consideration in order to save their firm. The agency cost is one of these assumption that is created in order to show the types of expenses that the firm should spend. It is divided into three types: expenditures to monitor managerial activities such as audit cost. Nowadays, auditing becomes one of the most important business issues that every organization especially the banking sector should apply. For example, due the agency problem, the Lebanese central bank oblige all the banking sector to have two independent big four auditors in order to assure all the financial information that is created by the managers. The second cost is the cost of structuring the organization such as appointing outside members to the board of directors or reengineering the organizational chart in the firm. To have a well design organization charts in a firm is very effective since it helps to allocate the jobs in a way that can m aximize efficiency and get rid of relation problems. The third cost is the opportunity cost that is created by the owner such as voting in specific issues and limit the ability of the managers regarding the actions that advance the shareholder wealth. For this purpose, many mechanism are introduced to the business world that can minimize those costs and solve the agency problems. First, compensation plan can be applied for the mangers such owning a stock in the firm and stock price changes. In this case, managers I obliged to work efficiently for the sake to increase the financial wealth to increase his or her stock value. Another extreme, is to have in the firm stockholders that have a theory X management style which means that they will manage each step or decision that is taken by the managers, but this would be costly and inefficient. The best solution to have a compensation that is based on performance and some monitoring should be undertaken. Moreover, the owner can create a s ense for managers that if they make any wrong decision that affect the firm negatively, they will be fired or replaced by another manager. However, this solution is somehow risky in a case that creates problems in the workplace. For example, many publicly traded companies are creating shares based on performance levels which are shared given for the mangers based on performance which are explained by many financial measures such as earing per share, return on assets, and return on equity etc†¦ If the performance is below the level, the shares will be less than 100 percent. These incentives are created for two main goals. First, they offer executives to take action that will increase shareholder wealth. Second, these types of plans help the firm to retrain managers that can have confidence to risk their financial wealth based on their abilities which can lead to better performance.

I read House of Sand and Fog by Andre Dubus III. This story is one of classic tragedy which also contains a nearly unbearable amount of suspense. It tells a story of the conflict between people of different races who have an inability to understand each other. They each want possession of a small house in the California hills but for very different reasons.   Ã‚  Ã‚  Ã‚  Ã‚  On one side, there is Kathy Nicolo and Sheriff Lester Burdon who want the house from which Kathy was evicted. It previously belonged to Kathy’s father and she is reluctant to relinquish possession of it. Then there is the Behranis, a Persian family who was forced to flee to America in fear of their lives. They want the house because it symbolizes their rise from poverty (they had to leave everything behind and were quite poor when they arrived in the United States) back to affluence which, to this family, will help to restore their family’s dignity, lost when thrust into poverty. The story centers on gaining possession of the house. Unknowingly, all of these characters are doomed to tragedy by their inability to understand each other, hurtling down an explosive collision course.   Ã‚  Ã‚  Ã‚  Ã‚  The main characters in this story are Sheriff Lester Burdon, Kathy Nicolo, Massoud Amir Behrani, Mrs. Behrani, and their son, Esmail Behrani. By having another source other than yourself see what you are capable of doing, it lets people see themselves from a different perspective. There are many examples in modern day society of Goethe’ s statement. A positive example of a modern day Goethe statement is in the Army. When a person thinks of the Army, the first thing that a person will think of is the quote â€Å"Be all that you can be.† The is an encouraging statement for people, and this will make people feel as if they can be part of something more helpful and proud. If a person exerts their whole self into becoming a soldier, and if other people tell them that they have the power to be more than just average, then, they put forth more effort, and feel better about themselves. Another positive example is in the acting business. While an actor is on stage saying his lines, he might meet the criticism of the director. The director of a play should know the ability of an actor, and by criticizing him; it is helping them become a better actor. There are also people with professions that, on a daily basis, they help people better themselves. These people are teachers and tutors. Teachers and students interact with each other more out of a day than most students interact with their parents. Teachers help us expand and open our mind by giving us skills throughout students’ early life to help students when they are older. By learning information from teachers, students become better people, in a couple of ways. Besides inquiring knowledge from their teachers, students learn to work with one another, open their mind to other peoples’ thoughts and ideas, respect one another, and learn different techniques for life’s issues.

In her article â€Å"Abortion is not a bad thing†, published on June 24, 2013, the family medicine practitioner and the founder of the Reproductive Health Access Project medical director Dr. Linda Prinehighly defend and stick to the issue that abortion itself as an experience can be positive however our culture fails to praise the women rights in taking life-term decision and demonizes women instead for having an abortion. She also shed the light on the importance of supporting the women on abortion to destigmatize the associated shame.Prine sees that it is quite enough to struggle for education and work, and here comes abortion to postpone having childrenuntil better ambience for rising children is ensured. She had succeeded to an extent in doing her aim.She was absolutely credible in trying to persuade us that abortion is really not a bad thing bytaking advantages of the readers emotions using a sensual languageby giving several life examples she used to experience in her career that made her certain that abortion is not that bad as the 16-year-old couple who came scared to her clinic, and how they relaxed a bit after she talked to them when they realized that she is helping them as well as the two mother/daughter pairs who realize d after her visit how great their jobs when they are supporting their daughters goals in getting more education.The audience definitely empathizes with the women’s psychological state and the fear she feels before abortion and that after, this is the emotional appeal, it is an appeal to pathos. Here appealing to ethos is absolutely achieved as this is a clear zoom into the writer’s character and his respect to the reader.She insists that our societies are responsible for damaging the woman’s image for having an abortion which can be almost positive, while they should be supportive and respective for the women and their decisions, supportive relationships and experience. The logical reasoning she followed is well detailed and with no hard terminology it coul d be followed easily. She emphasizes the necessity to decrease the shame associated with abortion so that it becomes something normal and undebatable. She suggests and encourages as a doctor the support of women having abortion especially from the closely people.She also sees abortion as positive in postponing children till better life situations are achieved. Logical fallacies were evaded which is excellent. To make it simple, she makes the reader well understand the importance and how serious the issue is especially when she related the positive effects of abortion to the women world especially and to the society as a whole. She is absolutely a good persuader. One cannot deny that Prine was so logical in the way she presented her issue and supported it.Not only she let the issue enter into the reader’s heart, but she made that heart think how tender she is to be concerned with the promotion of the women rights by this way. She was biased in developing her argument as she ne glected to state any counterargument. She even disagreed with the activists of abortion rights that they need to decrease the number of abortions. She insists instead that abortion is very normal. Outlining few opposing views would have made her argument better, no counter arguments were present.As a family doctor and writer at the same time, her role should notbe limited only to ease the abortion for females, her duty must extend to awake young couples before committing the mistake of unwanted pregnancy. In her argument she only stuck to the necessity of social acceptance of women having abortions but she didn’t mention any moral, religious and conscious overview. Abortion is against God, it is denied by all religions. Abortion is also related to the basic human values, so women should be less egoistic and more humanitarian regarding those unborn babies.Abortion is not safe, she shouldn’t have muted this issue as a family doctor as she should know that abortion indust ry is not regulated and it can be accompanied with a mother death. She should have stated medical and social wise that it is a better alternative than having a defective fetus or child. All of those were not mentioned. Prine’s work presented abortion as a solid basis towhistle blow the need of the women rights in the society and the importance of respecting them. An underestimation of the effects of mentioning the counterarguments decreased her creativity. Although the way she presents her claim is so logical.
